Dubai freehold property is one of the most common assets in an expat estate, and one of the most exposed without a will. Title deeds are issued in specific names, and the Dubai Land Department applies UAE inheritance rules by default when an owner passes away, regardless of what you assumed would happen.
Joint ownership does not automatically transfer to the surviving partner. The property forms part of the estate and is distributed by court order. In the meantime, the title is effectively locked: you cannot sell, refinance, or rent it out without the necessary court documents in hand.
Off-plan units add another layer of complexity. Payment plans still have to be honoured, developers want to know who the new owner of record will be, and any delay in establishing succession can affect handover, snagging, and final registration. A clear will avoids the whole queue.
